Van Cott’s Tax and Estate Planning Group advises clients in a number of important practice areas, including Business Formation and Transactions, Taxes, Estate Planning, Trust and Estate Administration, Retirement Benefits, and Charitable Organizations.

Business Formation and Transactions
Van Cott attorneys advise clients who are starting new businesses as they choose from among the many different entities available for conducting business, such as limited and general partnerships, limited liability companies, S corporations, and C corporations, and also assist clients in creating and operating these entities. In addition, Van Cott attorneys advise clients on the tax ramifications of many different types of business transactions, such as redemptions, liquidations, sales, acquisitions, mergers and reorganizations, and tax-free exchanges.

Taxes

We offer complete tax planning services. We represent clients before the Internal Revenue Service, the Utah Tax Commission and other tax authorities.

Estate Planning

Members of the firm’s Tax and Estate Planning Group assist clients in all aspects of the estate planning process, including the preparation of wills, durable and medical powers of attorney, and all types of trusts; the various forms of gifting and charitable giving; the formation of family limited partnerships and limited liability companies; and asset transfers and asset protection. They also advise clients with respect to the tax issues that arise in the estate planning area, and have worked extensively with the income, gift, estate, and generation-skipping transfer tax laws.

Trust and Estate Administration
The Tax and Estate Planning Group also represents clients with respect to the administration of trusts and estates, including probate, the division and distribution of assets, income tax matters, and the preparation of federal estate tax returns.

Retirement Benefits
Van Cott attorneys assist clients with planning for many different types of retirement benefits, including those held in the form of IRAs, 401(k)s, 403(b)s, profit-sharing plans, and non-qualified deferred compensation plans. In particular, they help clients with planning for minimum required distributions and maximizing income tax deferral.

Charitable Organizations
Members of the Tax and Estate Planning Group advise clients in organizing and operating tax-exempt entities such as private foundations, supporting organizations, and public charities.
